1. Acceptance of Terms
By accessing or using the Swisscofunding platform ("Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the Platform. These Terms constitute a binding agreement between you and Swisscofunding AG.
2. Platform Description
Swisscofunding is a Swiss-origin digital platform providing services related to tokenized corporate finance, cross-border treasury management, and blockchain-powered capital formation. We operate following Swiss market best practices and are committed to Swiss-grade transparency.
3. Eligibility
To use the Platform, you must: • Be at least 18 years of age • Have the legal capacity to enter into binding contracts • Not be a resident of a jurisdiction where such services are prohibited • Complete any required identity verification (KYC/AML) procedures
4. Account Registration
You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities occurring under your account. Notify us immediately of any unauthorized use.
5. Permitted Use
You agree to use the Platform solely for lawful purposes and in accordance with these Terms. You must not: • Use the Platform to engage in fraud, money laundering, or any illegal activity • Attempt to gain unauthorized access to any part of the Platform • Introduce malicious code or interfere with Platform operations • Reproduce, duplicate, or exploit any part of the Platform without written consent
6. Digital Assets & Tokenized Instruments
Digital assets and tokenized instruments available on the Platform involve significant risk, including potential loss of principal. Past performance is not indicative of future results. Nothing on the Platform constitutes financial, legal, or investment advice. You are solely responsible for your investment decisions.
7. Learn-to-Earn Rewards
Quiz rewards are distributed in cryptocurrency tokens as described on the Platform. Reward availability is subject to change. Swisscofunding reserves the right to modify, suspend, or terminate the rewards program at any time without prior notice. Rewards have no guaranteed monetary value.
8. Intellectual Property
All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, and software, are the exclusive property of Swisscofunding AG and are protected by Swiss and international intellectual property laws.
9. Limitation of Liability
To the fullest extent permitted by Swiss law, Swisscofunding AG shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Swisscofunding AG and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of the Platform or violation of these Terms.
11. Termination
We reserve the right to suspend or terminate your access to the Platform at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
12. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with Swiss law, excluding its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use constitutes acceptance of the updated Terms. We recommend reviewing these Terms periodically.
